NVR, Inc. Class Action Lawsuit

If you worked for NVR, Inc. (or a related company such as Ryan Homes, NVHomes or Fox Ridge Homes) as a Sales and Marketing Representative ("SMR"), or a sales and marketing associate ("SMA"), you were supposed to be paid time and one-half for any time you were permitted to work over 40 hours in a week.

This is true whether you were called a commissioned, salaried, hourly, exempt or non-exempt employee.

You are owed this money even if you agreed to work this extra time, and even if you did not expect to get paid for it.

If you did what was described above, you are likely entitled to overtime payments through this lawsuit.

The lawsuit was brought after a team of attorneys investigated NVR’s practices and concluded that NVR systematically failed to pay proper overtime to a group of its employees. This lawsuit is currently pending in United States District Court for the Western District of New York. The court has not made any determinations concerning the scope of the class.

How to Request a Ruling as to whether NVR, Inc. Did Not Pay You Wages and Overtime

The court has approved notice. If you decide to join this lawsuit, the consent form and attached information sheet must be postmarked no later than Wednesday, September 12, 2007, in order to allow plaintiff’s counsel sufficient time to file the opt in consent form with the federal court.

Should NVR be found to have not paid you overtime and/or failed to pay you for overtime for all hours worked, a Court will decide how much overtime NVR owes you.

You qualify to join this action if:

  1. If you are/were employed in the homebuilding unit of NVR, Inc. (or related company such as Ryan Homes, NVHomes or Fox Ridge Homes).
  2. You were permitted by NVR, Inc. to work more than 40 hours in a week in at least one week.
  3. You were not paid time and one-half for hours you worked over 40 in at least one week.
  4. Your job was Sales or Marketing Representative ("SMR"), or Sales and Marketing Associate ("SMA"), or you performed the duties of an SMR or SMA.
